Wesley Medical Center was negligent in the 1984 death of an 11-year-old boy who choked on a meal while he was a patient at the hospital, a Sedgwick County jury has found.
Jurors awarded the family of 11-year-old Lin Mar nearly $157,000 after a two-week trial. Bradley Prochaska, a lawyer for the Mar family, argued that Lin Mar probably would be alive if nurses had used the Heimlich maneuver to dislodge a piece of chicken he was choking on. The boy had been hospitalized only hours before his death for an asthmatic condition.
Prochaska also presented evidence that hospital personnel had altered Mar's medical records to conceal the fact that he choked to death.
